Krgo Terms and Conditions

The conditions under which Krgo buys, imports and delivers a product on the customer's behalf.

1Who we are

Krgo is an assisted purchasing and importing service operated in Costa Rica, buying on the customer's behalf. These terms govern the relationship between Krgo and the person using the platform, and are accepted when an account is created and when an order is confirmed.

Krgo is not the seller of the product. The sale of the item originates on the online marketplace where it is listed; what the customer contracts with Krgo is the handling of that purchase, its import and its delivery in Costa Rica.

Pending decision

Registered company name, corporate identity number and legal address. The company has not been incorporated yet, and until it exists there is no legal person to enter into this contract.

2What Krgo does and does not do

The customer sends the link to a product listed on one of the marketplaces the platform supports. Krgo reviews the seller, works out the full cost landed in Costa Rica, buys the product on the customer's behalf, handles its import and delivers it.

Krgo acts as an agent on the customer's account: it advances the product price, the shipping, the duties and the customs clearance, and charges them inside the total price alongside its commission.

  • Krgo neither manufactures nor sells the product: the quality, the authenticity and the conformity of what is dispatched are the origin seller's.
  • Krgo does not provide transport services. It contracts carriers and consolidators on the customer's behalf.
  • Krgo only handles products listed on the marketplaces the platform supports.

3Definitions

In these terms, and in the documents that form part of them, the following words mean:

  • Product: an item in Krgo's catalog, or the one that results from reading a link the customer sent.
  • Cart: the list of products the customer has gathered, with no price frozen yet.
  • Shipment: the products of a single origin that travel together. A cart holding products from two origins is two shipments.
  • Order: a shipment with its price frozen, awaiting payment or already paid.
  • Breakdown: the detail of every line that makes up an order's price, stored with the order.
  • Route: the origin the goods are imported from. Asian marketplaces consolidate with each other and United States marketplaces with each other; the two are never combined.

4Account

Browsing the catalog and filling a cart need no account. Asking for a link to be read does need an account with a verified email address.

The email address is the account's identity. An account is created with an email and a password, or by signing in with Google or Facebook. The phone number is not asked for at registration: it is asked for at the delivery step, as part of the address, so the courier can call.

The customer is responsible for keeping their credentials confidential and for the activity carried out from their account. When the password is reset, Krgo ends every open session.

The account is personal. Krgo may suspend it in the face of use that puts the operation or third parties at risk, and will tell the customer why.

5The catalog, the product and approximate information

The catalog shows products Krgo has already read. The photographs, the descriptions and the specifications come from the origin marketplace and may have been translated automatically.

Where a product's weight, dimensions, translation or tariff classification come from an automatic extraction or from an estimate, the screen says so with an approximate-price notice. That notice is derived from where the figure came from, not from a flag set by hand.

A product whose weight is still a machine's answer cannot be added to a cart: the platform holds it until somebody at Krgo has reviewed it. That is deliberate — an estimate may reach a screen and may not reach a charge.

Krgo may correct the catalog's content at any time. A correction takes effect immediately on every screen and in every cart, and never on an order already frozen.

6Cart and mixed origins

A cart may gather products from several origins, but each origin travels on its own. A cart combining Asian and United States products is two shipments: two shipping charges, two commissions, two orders and two payments.

The platform says so in the cart, before showing any figure at all.

The cart's price is recomputed on every visit from the catalog and the rates in force. Nothing is fixed until checkout.

One shipment is paid for at a time. The cart stays open with whatever was not paid for.

7What the price includes

The total price the platform shows for a shipment includes the product, the international shipping, the import duties, the customs clearance, delivery inside Costa Rica and Krgo's commission with its value added tax.

The breakdown is shown as separate lines and none is folded into another. The card payment surcharge is part of the total from the cart onward, because the card is the only payment method available and there is no total without it.

Delivery inside Costa Rica is charged by zone. The cart and the checkout price it for the zone of the customer's default address or, where there is none, for the Greater Metropolitan Area, and the screen names the zone used. The final amount is the one for the address the customer chooses at payment.

The figures that govern an order are the ones in force at the moment of checkout, and they are stored in its breakdown. The ones in force today are these:

8Krgo's commission

Krgo charges a commission on marginal brackets over the subtotal before commission — product, shipping, duties, customs clearance and delivery. The brackets are marginal: each portion of the subtotal pays its own rate, and the commission is never charged on itself.

The commission is a service provided in Costa Rica and carries value added tax, shown as a separate line.

The minimum commission is charged once per shipment, not per product.

9Exchange rate

Purchases abroad are paid in foreign currency. Krgo applies a fixed spread on each unit converted, on every conversion the order requires, and that spread appears as a line of its own in the breakdown rather than hiding inside the exchange rate.

The exchange rate the platform uses is administered by Krgo and set by hand; no automated job changes it. Whichever rate is in force at checkout governs that order and its invoice, and is stored in the breakdown.

An order on the Asian route may cross three currencies. Each conversion is recorded separately, with its rate and its purpose.

10Import duties and billable weight

Duties are calculated on the CIF value declared to Costa Rican customs, made up of the product price and the corresponding leg of international transport. The duties are the customer's as importer; Krgo advances them and charges them inside the total price.

The tariff classification determines the rate that applies. Krgo proposes it with the help of automatic tools and a person confirms it; while nobody has confirmed it, the screen warns that the price is approximate.

Where a category requires an import permit or pays a high rate, the platform says so before the product can enter a cart.

Shipping is charged on the weight the carrier bills. Depending on the provider that is either the real weight or the greater of the real and the volumetric weight, and each provider sets its own rounding: most round up to the next whole kilogram and one bills in pounds. The breakdown states which weight was used and under which rule.

11The order and the payment window

The order comes into being when the customer takes a shipment from the cart through checkout. At that moment the platform freezes the price and stores the complete breakdown: every rate, every percentage, every rounding rule and every exchange rate used.

From then on nothing is recomputed. A later change to the catalog or to the rates does not alter an order already issued.

The order has a window in which to be paid, counted from checkout and published in the section above. The platform sends a reminder and a warning before it runs out. Once it does the order expires, and buying again means building it again at the prices in force at that time.

A shipment has one open order at a time. A declined payment attempt does not create a second order.

12Payment

The only payment method is a credit or debit card, charged inside the same purchase flow through the ONVO Pay gateway.

The card details are typed into fields the gateway itself draws and travel straight to it. The card number, its expiry date and its security code never reach Krgo's servers and are stored in no Krgo record.

The payment carries a surcharge, shown as a line of its own from the cart onward. That surcharge passes on a financial cost and carries no tax of its own.

A declined card does not advance the purchase and does not create a new order. The customer may try again on the same order while its window is still open.

Krgo buys nothing while a payment is not confirmed by the gateway.

13The purchase at origin

Once the payment is confirmed, Krgo buys the product on the origin marketplace within the next thirty minutes, during business hours.

If the seller cannot complete the sale — because the product sold out, changed price or is no longer available — Krgo tells the customer and offers an equivalent product or a refund, in line with the cancellations, returns and warranty policy.

14Delivery times

Times are estimates and are not a guarantee. They depend on the seller, on the carriers and on customs, all of whom are third parties.

Krgo reports the progress of each stage in the customer's portal, and also by email for the payment, the dispatch, the delivery, a cancellation, a refund or an incident.

Krgo offers no delivery-time commitment with a remedy of its own. The commitments some providers publish are theirs and are not passed on to the customer.

The ranges in force per route are these:

15Insurance and contingencies

Shipments are covered, on the terms each transport provider offers, against total loss of the parcel, partial loss, customs seizure and return of the parcel.

The cover that applies is stated in each order's breakdown, on the real terms of the provider carrying that shipment. Krgo files the claim with the provider and keeps the customer informed.

16Products Krgo does not handle

Krgo does not handle products whose import is prohibited or restricted under Costa Rican law, nor those requiring permits the customer cannot produce.

Krgo only reads products listed on the marketplaces the platform supports. Any other link is refused with a message explaining why and is handled, where appropriate, through the human WhatsApp channel.

Krgo may refuse a purchase where its own review has marked the origin seller as blocked. A later block does not affect an order already paid for: the next purchase stops, and a promise already made is not touched.

17Seller review

Krgo reviews the origin seller before buying. That review is a decision made by a person at Krgo with data to help; no automatic tool assigns a trust level.

The review reduces the risk without removing it. It is not a guarantee of the quality, the authenticity or the conformity of the product, which are the origin seller's.

18Cancellations, returns and warranty

The conditions for cancellation, return and warranty are set out in a separate document, which forms part of these terms and is linked at the foot of this page.

19Reviews and customer content

Only somebody who has received the product through Krgo may write a review, and each review is tied to the line of the delivered order.

Reviews are published under the name the customer chooses to display and may include photographs the customer contributes. Krgo reviews them before publishing and may refuse one containing third parties' personal data, unlawful content or material unrelated to the product.

By publishing a review the customer authorises Krgo to show it on the product page and to answer it publicly. It can be withdrawn by asking through the contact channels.

20Personal data

The processing of the customer's personal data is governed by the privacy policy, which forms part of these terms and sets out which data is collected, what for, who it is shared with, how long it is kept and how to exercise the rights Law 8968 grants.

21Communications

Krgo communicates with the customer by email and through their account on the platform: account verification, notice about a link that was read, payment reminders, expiry warnings and the order's events.

WhatsApp is a human support channel and not an automated channel of the service. The platform sends no text messages and no automated WhatsApp messages.

The newsletter is optional, is asked for separately and can be cancelled at any time.

22Invoicing

Krgo issues an electronic invoice for its service under the rules of the Dirección General de Tributación. To issue it, the customer's identity number is asked for at the payment step.

Pending decision

The electronic invoicing provider has not been selected yet and registration as a taxpayer is pending. Until then this clause cannot be asserted as a fact.

23Liability

Krgo answers for the service it provides: the correctness of the calculation it communicates, the actual purchase of the product requested, the contracting of transport and the information about the order's state.

Krgo does not answer for the acts of third parties outside its reasonable control: the quality or conformity of what the seller dispatches, delays by carriers or by customs, customs decisions about a shipment, or events of force majeure.

Nothing in this clause limits the rights Law 7472 on the Promotion of Competition and Effective Consumer Defence grants the customer.

Pending decision

The quantitative liability cap and how it relates to the transport providers' own cover have to be reviewed by the lawyer. No project document decides them.

24Changes

Krgo may amend these terms. The version in force is the one published on this page, with its last-updated date.

Amendments govern orders issued after they are published and do not affect an order already paid for or an invoice already issued.

25Governing law

These terms are governed by the law of the Republic of Costa Rica, in particular Law 7472 on the Promotion of Competition and Effective Consumer Defence and Law 8968 on the Protection of the Individual with regard to the Processing of their Personal Data.

Pending decision

The forum and the dispute-resolution mechanism — the administrative route before the Comisión Nacional del Consumidor, arbitration or the courts — are the lawyer's to settle.
